W-2, W-3 and 1099-NEC deadline 2027: February 1, 2027 for tax year 2026, with each state's W-2 filing date

Form W-2 and Form 1099-NEC for tax year 2026 are due on Monday, February 1, 2027, both to the worker and to the government, because January 31, 2027 is a Sunday. The IRS's 2026 General Instructions for Forms W-2 and W-3 put the Social Security Administration (SSA) filing date at February 1, 2027 for paper and electronic filers. Form 940 and the fourth-quarter Form 941 are also due February 1, 2027 (February 10, 2027 if every deposit was made on time). Most states that tax wages want their copy of the W-2 by the same late-January rule, but several use other dates, listed state by state below.

The table gives the actual 2027 date for each employer return or statement. Dates marked draft come from IRS early release drafts posted at IRS.gov/DraftForms; the IRS labels these "DRAFT—NOT FOR FILING" and says drafts can change before final release.

Why the dates move off January 31 and February 28

The base dates are January 31 (W-2, 1099-NEC, Form 940, Q4 Form 941), February 15 (1099-MISC boxes 8 and 10 to recipients) and February 28 (paper 1099-MISC to the IRS). The Instructions for Forms 1099-MISC and 1099-NEC say that if a date falls on a Saturday, Sunday, or legal holiday in the District of Columbia or where the return is to be filed, the due date is the next business day. In 2027, January 31 and February 28 are Sundays, so those deadlines become Monday, February 1 and Monday, March 1. February 15, 2027 is Washington's Birthday, a federal holiday on the U.S. Office of Personnel Management's 2027 schedule, so the box 8 and box 10 statements move to Tuesday, February 16, 2027, the date in the Publication 509 draft.

The 941 instructions give the general rule: the return is due the last day of the month after the quarter ends, and an employer that made timely deposits in full payment of the quarter's taxes "may file by the 10th day of the 2nd month that follows the end of the quarter."

E-filing: 10 returns in total, through IRIS

An employer must e-file Forms W-2 if it is required to file at least 10 information returns, counting Forms W-2 and other information returns (such as 1099s) together. The 1099 instructions trace this to T.D. 9972, which lowered the threshold from 250 to 10, effective for returns required to be filed on or after January 1, 2024. A waiver can be requested on Form 8508 at least 45 days before the due date. Publication 1099 (2026) says that beginning with tax year 2026 (filing season 2027) the Information Returns Intake System (IRIS) will be the only IRS intake system for information returns, and the FIRE system will not be available after it shuts down at the end of 2026.

The 1099 threshold is $2,000 for 2026 payments

For tax years beginning after 2025, the minimum reporting threshold for payments on Form 1099-NEC and most Form 1099-MISC boxes rose to $2,000, and the IRS says it may be adjusted for inflation beginning in calendar year 2027. The Publication 1099 guide still lists $600 or more for gross proceeds paid to attorneys (1099-MISC box 10) and for cash fish purchases, and $10 or more for royalties.

Extensions: limited for W-2 and 1099-NEC

  • Filing Form W-2 with SSA: one 30-day extension may be requested on Form 8809 before the due date. The W-2 instructions say "The IRS will only grant the extension in extraordinary circumstances or catastrophe." It does not extend the date for giving employees their copies.
  • Furnishing W-2s to employees: request on Form 15397 on or before February 1, 2027. The W-2 instructions say an approved extension is generally no more than 15 days, unless the need for up to 30 days is clearly shown.
  • 1099-NEC: Publication 1099 says "For Forms W-2 and 1099-NEC, no automatic extension is available."
  • 1099-MISC to the IRS: an automatic 30-day extension is available on Form 8809 if it is filed by the due date of the returns (Publication 1099).

Penalties for late or incorrect W-2s due in 2027

The 2026 W-2 instructions list the section 6721 penalty amounts that "apply to filings due after December 31, 2026." The same amounts apply separately, under section 6722, to late or incorrect copies given to employees, so one late W-2 can draw two penalties. A small business here means average annual gross receipts of $5 million or less for the 3 most recent tax years.

State W-2 and annual reconciliation deadlines for tax year 2026

The table covers the 41 states and the District of Columbia that tax wage income. Rule is the date as the state writes it. For 2026 forms shows a 2027 date only where the state's own page prints one, or where the state's page has a stated weekend rule and the base date falls on a weekend; otherwise it says not stated. January 31, 2027 is a Sunday, and the states' own pages differ: Georgia and Vermont list February 1, 2027, while Nebraska and Pennsylvania print January 31, 2027. State dates and forms were read on the state pages linked in each row on 2026-10-17. Local income tax filings (cities, counties, school districts) are not covered.

State filing of W-2 copies and annual withholding reconciliations for tax year 2026, as stated on each state's page. Checked 2026-10-17. Sources: the state revenue or labor agency page linked in each row.

Two state documents disagree with themselves or with each other. Wisconsin's Publication 166 says W-2s "are due February 2" (the 2026 date for tax year 2025), while Publication 117 says January 31. Hawaii's withholding page carries both the January 31 rule (effective 2022) and an older February 28 answer that refers to Form HW-3. The table uses the rule each state labels as current and notes the other text.

States without a wage income tax

Nine states are not in the table. Six of them say so on their own state websites: Florida ("The State of Florida does not have a personal income tax"), Nevada, South Dakota, Tennessee ("Tennessee has no state income tax on earned income and therefore has no withholding requirements"), Texas and Wyoming. Washington's Department of Revenue says Washington "does not currently have an individual income tax" and that a new 9.9% tax on income above $1 million begins January 1, 2028. Alaska and New Hampshire are also commonly listed as having no wage income tax, but we could not read a state page for either on 2026-10-17 (Alaska's site disallows automated reading; New Hampshire's refused the request).

For the FUTA side of Form 940, see FUTA credit reduction states for 2026. For the box 3 wage cap on 2027 Forms W-2, see the 2027 Social Security wage base, and for state unemployment wage caps, the 2027 SUI taxable wage base by state.

What we could not confirm

  • Final IRS versions of Publication 509 (2027) and the 2026 Form 940 instructions. The 1099-NEC, 1099-MISC, Form 941 and Form 944 dates for 2027 and the Form 940 dates come from early release drafts read 2026-10-17; the W-2 dates come from the final 2026 W-2 and W-3 instructions.
  • Colorado and Massachusetts: the state sites (tax.colorado.gov, mass.gov) refused our automated request (HTTP 403) on 2026-10-17, so no form or date is given.
  • Maine's W-2 due date: the Maine Revenue Services pages we could read say Form W-3ME was discontinued and W-2s go through the Maine Tax Portal, but the PDF that would give the date was not readable.
  • Maryland's current-year page loads by script; the rule shown comes from the Comptroller's guides for 2024 forms.
  • Whether Iowa and New Jersey move their February 15 date when it falls on a federal holiday (February 15, 2027). New Jersey's page has a holiday rule; Iowa's page does not mention one.
  • New Mexico: one state page says January 31 and another says the last day of February; neither names a 2027 date.
  • The District of Columbia's annual reconciliation form: the current OTR page could not be read, so only the W-2 submission date is shown.
  • 2027 penalty amounts on the IRS Information return penalties page: as of 2026-10-17 that page lists amounts through returns due in 2026.

Questions

What is the W-2 deadline in 2027?
February 1, 2027 for 2026 Forms W-2, both for giving copies to employees and for filing Copy A with Form W-3 at the SSA, on paper or electronically. January 31, 2027 is a Sunday.
When is the 1099-NEC due in 2027?
February 1, 2027, both to recipients and to the IRS, whether filed on paper or electronically (IRS Publication 509 (2027) draft). There is no automatic extension for Form 1099-NEC.
When is the 1099-MISC filing deadline in 2027?
Recipient copies are due February 1, 2027 (February 16, 2027 for amounts in box 8 or box 10). Copy A is due to the IRS March 1, 2027 on paper or March 31, 2027 if filed electronically.
Do states have a different W-2 filing deadline?
Most states that tax wages use January 31, but Iowa and New Jersey use February 15, Missouri gives employers with fewer than 250 employees until the last day of February, and New York does not take W-2 copies at all. Each state's rule is in the table above.
How many W-2s and 1099s trigger the e-file requirement?
Ten. An employer that files 10 or more information returns in total, counting W-2s and 1099s together, must e-file all of them with the SSA and IRS. Many states set their own, different thresholds.
